General conditions of use of the portal

ACERTA CERTIFICACIÓN S.L. informs you that it is the owner of this portal, and that the access and use of the web page https://acerta-cert.com/.(hereinafter, "the portal") and all the subdomains and directories included under it, as well as the services or contents that can be obtained through it, are subject to the terms detailed in this Legal Notice.

The user is obliged to make a correct use of the portal in accordance with the Law and the present Legal Notice. The user will be liable to ACERTA CERTIFICACIÓN S.L. or third parties for any damages that may be caused as a result of a breach of this obligation.

Any person accessing this Portal assumes the role of user, committing to the observance and strict compliance with the provisions herein, as well as any other legal provision that may be applicable.

Intellectual and industrial property rights

In accordance with articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution and public communication, including making available, in whole or in part, of the contents of this Portal for commercial purposes, in any format and by any technical means, without the prior and express authorization of ACERTA CERTIFICACIÓN S.L., is expressly prohibited.

Obligations and responsibilities
User Commitments

The User agrees to:

a) Make proper and lawful use of the Portal, as well as its contents and services, in accordance with: (i) the legislation applicable at all times; (ii) the General Conditions of Use of the Portal; (iii) the rules of morality and generally accepted good customs; and (iv) public order.
b) Provide all the means and technical requirements necessary to access the Portal.
c) Provide truthful information when completing the forms with your personal data on the Portal, keeping them updated at all times, so that they reflect the real situation of the User.

The User will be the only responsible for the false or inaccurate statements made and for the damages caused to ACERTA CERTIFICACIÓN S.L. or to third parties for the information provided.

Notwithstanding the foregoing, the User agrees to refrain from:

a) Make unauthorized or fraudulent use of the Portal and/or its contents, for illicit purposes or effects, prohibited by these General Conditions of Use, that harm the rights and interests of third parties, or that may in any way damage, render useless, overload, deteriorate or impede the normal use of the services, documents, files and any content stored in the computer equipment.

c) Cause damage to the physical or logical systems of the Portal, its suppliers or third parties.

f) Obtain or attempt to obtain the contents using means or procedures other than those which, as the case may be, have been made available for this purpose or have been expressly indicated on the web pages where the contents are found, or, in general, by means of those methods which are normally used on the Internet without risk of damage or disablement of the Portal and/or the contents.
g) In particular, and by way of example (not exhaustive), the User undertakes not to transmit, disseminate or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software, and in general any type of material that:

  • Is contrary to, undermines or infringes upon the fundamental rights and public freedoms recognized in the Constitution, in international treaties and in the legislation in force.
  • Induces, incites or promotes criminal, denigratory, defamatory, violent actions or actions contrary to law, morals, generally accepted good customs or public order.
  • Incorporates, makes available or allows access to products, elements, messages and/or services that are illegal, violent, offensive, harmful, degrading or contrary to the law, morality and generally accepted good customs or public order.
  • Induces or may induce an unacceptable state of anxiety or fear.
  • Incites dangerous practices, risky or harmful to health or mental well-being.
  • Is contrary to the honor, personal and family privacy or self-image of persons.
  • Constitutes any type of unauthorized advertising.

If the User breaches in a negligent or fraudulent way any of the obligations established in the present General Conditions of Use, he/she will be responsible for the damages caused to ACERTA CERTIFICACIÓN S.L. by such breach.

Likewise, ACERTA CERTIFICACIÓN S.L. does not guarantee the continuous access, nor the correct visualization, download or utility of the elements and information contained in its pages, since these can be impeded, hindered or interrupted by factors or circumstances beyond its control.

ACERTA CERTIFICACIÓN S.L. is not responsible for the decisions taken as a result of access to the contents or information offered. In addition, it may interrupt the service or immediately terminate the relationship with the User if it detects that the use of its Portal is contrary to these General Conditions of Use.

Exclusion of Liability

ACERTA CERTIFICACIÓN S.L. shall not be liable for damages, losses, claims or expenses arising from the use of the Portal. It shall only be responsible for removing, as soon as possible, the contents that may cause such damages, provided that proper notice is given.

In particular, ACERTA CERTIFICACIÓN S.L. will not be responsible for damages derived from:

a) Interferences, interruptions, failures, omissions, telephone breakdowns, delays, blockages or disconnections in the operation of the electronic system, caused by deficiencies, overloads or errors in telecommunications lines and networks, or any other cause beyond its control.
b) Illegitimate intrusions through the use of malicious programs of any kind through any means of communication, such as computer viruses or others.
c) Improper or inappropriate abuse of the Portal.
d) Security or navigation errors caused by a malfunction of the browser or the use of non-updated versions of the same.

The administrators of the Portal reserve the right to withdraw, in whole or in part, any content or information present on the Portal.

Likewise, ACERTA CERTIFICACIÓN S.L. excludes any liability for damages of any kind arising from the misuse of the Portal by the Users. The User undertakes to defend, indemnify and hold harmless ACERTA CERTIFICACIÓN S.L. against any damage or prejudice derived from claims, actions or demands of third parties as a consequence of their access or use of the Portal.

Applicable Law and Jurisdiction

For the resolution of all disputes or questions related to this Portal or the activities developed in it, will apply Spanish law, to which the parties expressly submit themselves, being competent for the resolution of all disputes arising from or related to its use the Courts and Tribunals of Madrid.
